The U.S. Justice Department is expected to oppose former vice-president Mike Pence's efforts and make the case that his co-operation is essential to the investigation into the Jan. 6, 2021 U.S. Capitol riot.

"Never before in American history has a vice-president been summoned to appear in court to testify against the president with whom they serve," he said. Aides argue that because he was serving in his role as president of the Senate on Jan. 6, he is protected under the Constitution's "speech or debate" clause from being forced to testify. "I have nothing to hide and I'm proud of what we accomplished. But for me, this is a moment where you have to decide where you stand, and I stand on the Constitution of the United States," he said.
