The move comes after an appeal was filed by the Haudenosaunee Development Institute Saturday morning.
Metrolinx has once again been ordered to pause tree removal at Osgoode Hall after an appeal was submitted by the Haudenosaunee Development Institute Saturday morning, the transit agency told the Star.
Following HDI’s submission, the Ontario Court of Appeal ordered that removal be paused until a hearing takes place on Tuesday, Metrolinx said. The HDI filed an injunction last week which was dismissed by Superior Court Justice Charles Hackland, according to Metrolinx. Hackland is the same judge who did not grant a request by the Law Society of Ontario to extend an injunction thatat Osgoode Hall. The injunction filed by the LSO expired at midnight Friday.
The interim injunction was granted on Sunday last week, stopping the provincial transit agency from cutting the trees until Feb. 10, when the court could address the issue in detail. “Contrary to popular belief, few if any of the trees go back further than World War Two, and there has been a lot of turnover over the years. Life is hard for city trees. Many of our trees, including the lindens, honey locusts, and flowering crab apples, date from 1965, and as time goes on, the tree cover will continue to change.”
“Indigenous consultation must be more than a box to tick. Consultation must be meaningful and collaborative. Two points Metrolinx misses time and time again,” the statement reads.
