“Mr. Kloeszar attempted to crawl away and Mr. Drummond followed as he continued to strike him. The entire assault was caught on video. Mr. Drummond struck Mr. Kloeszar 10 or 11 times. When the assault ended, Mr. Kloeszar was prostrate on the ground. Mr. Drummond dropped the baseball bat and left the scene.”
Gomery’s task was to determine a fit sentence. The Crown wanted a three to four year jail sentence, while the defence wanted a two-year non-custodial sentence.
