However, employment law experts, including Professor Andrew Stewart from the University of Adelaide have been sceptical about the practical value of casual conversion provisions, saying they have "little effect in practice".

Aside from the fact that casual employment genuinely suits some workers, Professor Stewart and colleagues have said that individual workers are often reluctant to challenge employers while still in a job. Under the Fair Work Act national employment standards, a casual employee is not entitled to annual leave which permanent employees receive. The act does not define an employee.

"The employer, of course, still has a right to refuse, but the employee could actually ask for that to be properly adjudicated rather than just have an arbitrary refusal," she said.
