Judge upholds fine handed out in connection with alleged kamikaze UCP leadership campaign yyc

In a written decision released Wednesday, Calgary Court of King’s Bench Justice Michael Marion rejected Jeffrey Park’s appeal of the punishment by the office of the Election Commission.Sign up to receive daily headline news from the Calgary Herald, a division of Postmedia Network Inc.By clicking on the sign up button you consent to receive the above newsletter from Postmedia Network Inc.

Callaway was alleged to have entered the campaign to undermine former Wildrose Party leader Brian Jean’s battle against eventual winner Jason Kenney. Callaway dropped out of the race and endorsed Kenney, who went on to become premier. Both sides denied any collusion. Marion ruled the penalty handed to Park didn’t amount to a true penal consequence or was similar to a criminal prosecution. As a result he could not argue his Charter rights in proceedings in criminal and penal matters were violated.

The judge also dismissed suggestions Election Commissioner investigator Dave Jennings and the commissioner himself had closed minds and prejudged the case.
