Defence and Crown will present additional submissions on March 21

Robby Ash, left, talks with his client, Noelle Laite, in provincial court in Corner Brook on Oct. 28, 2022. - SaltWire Network File PhotoCORNER BROOK, N.L. — Sometimes in criminal proceedings the sentences suggested by the Crown and defence can cause concerns for the judge hearing the matter, and that’s what happened as Judge Wayne Gorman reviewed the submissions on sentencing suggested in the trial of RNC officer Noelle Laite.

Laite was charged in March 2022 after an investigation by the Serious Incident Response Team of Newfoundland and Labrador . SIRT-NL launched its investigation on Jan. 31, 2022, after the RCMP notified the team of the allegations that had been made against Laite. O’Reilly suggested a sentence of 60 to 90 days, followed by probation, while Ash asked first for a suspended sentence with probation. At the time, Ash said that if Gorman found a period of incarceration was warranted, a conditional sentence of 30 to 60 days would be adequate.

After hearing the submissions, Gorman said he wanted time to consider them and set Monday, March 6, as the date to render his verdict.“I had an opportunity to consider them, and I find myself in the position that I have some concerns as regards to the adequacy of the sentencing range being proposed because of the seriousness of the two offences committed by Ms. Laite,” said Gorman.
