THUNDER BAY — A statement of claim filed by a man alleging harassment and false allegations made against him by the Thunder Bay Police Service has been dismissed by a Superior Court judge for being based on speculation and devoid of facts.
According to the statement of claim, the plaintiff alleges he was falsely accused of stalking someone “many years ago” and he believes the allegations were investigated and proven false. These actions, the plaintiff alleges, have resulted in the termination of his employment and the loss of close relationships with his family and friends and violated his charter rights.
Nieckarz agreed that the City of Thunder Bay and the Thunder Bay Police Service are not suable entities in this action and the claim was dismissed. However, leave was granted to name the Thunder Bay Police Services Board as the proper defendant. She highlighted several issues with the statement of claim, including a lack of material facts such as dates of the allegations, the use of speculation and innuendo, and statements added that are irrelevant, argumentative, inflammatory, and inserted only for colour.
