Annis was the trial judge in a 2019 case, in which a bilingual, francophone, Montreal-based employee of the Office of Superintendent of Financial Institutions sought to have the jobs of co-workers in Toronto re-designated as bilingual positions to allow him to work entirely in his first language of French.

However, those considerations were ignored by the Federal Court of Appeal, which subsequently overturned Annis’ ruling, and required 12 unilingual Toronto positions to be restaffed with bilingual workers. Annis says there are “irrefutable arguments” that provide grounds for appeal, namely the failure to consider the merit argument that he says trumps language rights “in any fair and reasonable staffing circumstance.”

He called C-13 “one-sided” legislation that favours francophones, with anglophones noticeably absent, even though their taxes will largely pay for any changes required. He takes particular exception to the requirement that Supreme Court justices need to be bilingual, a requirement he said will take 80 per cent of applicants “out of play.
