Free-speech advocates argued before the Supreme Court on Friday that a US law banning Chinese-owned TikTok echoes censorship practices of authoritarian regimes. PEN America, Columbia University’s Knight First Amendment Institute, and the Free Press urged the court to strike down the federal law, claiming it unlawfully threatens Americans’ access to foreign media and violates the First Amendment.
They compared the ban to actions taken by the Soviet Union and Chinese communists who jammed Western radio broadcasts after World War II, and modern-day Russia and China’s restrictions on platforms like Facebook, X, and YouTube. The Justice Department maintains that TikTok, as a Chinese company, poses a significant national security threat due to its access to vast amounts of American user data. Judges have accepted the government’s argument that the ban is meant to protect the US from a “foreign adversary nation” and hinder Beijing’s data collection efforts. However, the free-speech advocates contend that privacy legislation, rather than banning a popular platform, would be a more effective way to safeguard Americans’ data
