“The reason Parliament has imposed mandatory minimum penalties that are so high is because of the serious risk to our community when anyone operates a motor vehicle when they have alcohol or drugs in their system.” Lawless advised that on the day in question, he received a phone call from his wife, Penny Lawless, who was MacKay’s constituency assistant, stating she had been in touch with MacKay. She said MacKay was drinking in his vehicle in the New Ross area and sounded extremely intoxicated.

“Mr. Lawless then reached into the vehicle and attempted to unlatch Mr. MacKay’s seatbelt and physically remove him from the car. Mr. MacKay resisted and eventually took off in the vehicle.” Six days after the incident, MacKay sent two photos of his damaged vehicle to an online chat with members of his family, along with a message that said: “Don’t drink and drive. This could have been much worse for me and others. A totally stupid action on my part. I apologize to all of you.”

Defence lawyer Don Murray pointed out Lawless only called police after MacKay pleaded guilty in Halifax provincial court in early November 2019 to another charge of impaired driving, from a traffic stop near his home in Glen Haven the month before, on Thanksgiving weekend.
