He was sentenced after pleading guilty to charges of hindering a fishery officer and with interfering with the Membertou food fishery.Similar charges against a second man, Gregory Edward MacMullin, 39, of Sydney Mines, were previously dismissed.MacIntyre was facing four charges and was scheduled to stand trial in provincial court. However, he pleaded guilty to two counts and the other offences were dismissed.

The following day, fishery officers conducting a patrol of the harbour found a lobster trap with its mesh portions cut open rendering the device useless for fishing. The buoy rope had also been cut. A magenta-colored fishery tag was visible on the trap signaling it was from the food fishery.At around 9 p.m. on Dec. 3, fishery officers noticed some unusual activity taking place at the Ballast Grounds wharf in North Sydney.

Officers noticed a fishing vessel, registered to MacIntyre, with at least five people aboard leave the wharf area and fishery officers followed the vessel out into Sydney harbour.
