Fifth teen girl granted bail in ‘swarming’ death of homeless man Kenneth Lee

As of Monday, five of the eight girls had been released on house arrest and the other three remain in custody at youth detention facilities.

As with the other girls who have been released, the girl granted bail on Monday is effectively under house arrest and cannot leave her place of residence except in the presence of the person who has agreed to be responsible for them. Some of the girls have multiple people who signed what is essentially a court order agreeing to be responsible for them — a higher burden of responsibility than a standard surety.

The girls are also not permitted to have a cellphone, be on social media or access the internet except for school purposes. The girls’ release status will be in place until their charges are dealt with — either through a trial that acquits or convicts them, the girls entering a plea on the charges, or the case against them being dismissed. The direction of the case, at this early stage, has not been decided; it’s normal for a trial date to not have been set yet at this stage.

None of the evidence presented at the bail hearings — each stretching from morning hours into the evening — cannot be published ahead of the trial, which is typical for all bail hearings. The identity of the girls is also covered by a publication ban protecting young people charged with criminal offences, meaning there’s very little the Star can say about the girls or the case against them.

The girls — aged 13, 13, 13, 14, 14, 14, 16 and 16 — were arrested Dec. 18 by Toronto police and charged with second-degree murder in the death of Kenneth Lee, 59, who was homeless at the time. Police have described what they said was a “swarming” incident and said EMS found Lee had been stabbed. Lee was transported to hospital, but died of his injuries.
