"We're alleging both a breach of Sarah's charter rights as well as negligence on behalf of the medical team within Burnside, the correctional facility, Central Nova Scotia Correctional Facility … on behalf of the correctional staff," said Emma Halpern of PATH Legal, the lawyer representing the family.

"Then a few days later, when she was transferred to Halifax and the correctional centre here in Halifax for women, there should have been another assessment done and that also wasn't done. I think this is a really important piece to this, that … everyone knew she was very ill and yet nothing was done."The suit also aims to present proof to the court that Denny's human rights were also violated while in the last days of her life.
"The defendants consistently disregarded her deteriorating health and requests for assistance during her incarcerations at the facility," reads the claim.
