StarEditorial: Ontario's Crown policy forbids the use of restorative justice in sexual assault cases. No survivor should be forced to participate, but equally, no one should be denied the right to choose restorative justice if it’s right for them.

There’s a reason so many people who have been sexually assaulted prefer the label survivor to victim. It is because the term victim places them at the moment of a horrific event, whereas the term survivor places them in the aftermath — on the other side of it.

Ontario’s Crown policy on restorative justice is a case in point. As the Star explained in two recent stories, Crown policy forbids the use of restorative justice in sexual assault cases, even though some survivors would prefer to use it. In contrast, restorative justice is victim-centred. Although it can take different forms, the most common approach — conferencing — involves a facilitated, in-person or virtual meeting between survivors and offenders.

That can have an enormous therapeutic effect, and researchers have found that conferencing reduces fear, anxiety and other post traumatic stress symptoms among survivors.
