The chief executive of sprawling superannuation group Diversa Trustees, Andrew Peterson, allegedly retaliated against an executive who raised concerns about his “excessive swearing” and the company’s “poor monitoring and oversight of its regulatory obligations”.
In his complaint, Mr Harper described “disparaging comments made by Mr Peterson about other employees”, Mr Peterson’s “excessive and unreasonable swearing” and the habit of his boss to “repeatedly and unreasonably” contact him outside work hours.Mr Harper has alleged that after he raised concerns, a promised promotion was no longer discussed with him, while another employee, Tim a’Beckett, was given the role.
According to court documents, Mr Harper accepted taking over the role at a subsequent Zoom meeting in October, although Mr Peterson is alleged to have warned Mr Harper “this meeting is not taking place”. Mr Harper alleges that when he complained about this to Ms McNabb she agreed that he could not perform these duties while Mr Aivazidis remained in the role.Mr Harper further alleges that in October, he complained to Mr Peterson via email about Diversa’s “poor monitoring and oversight of its regulatory obligations” and the “lack of responses to requests for information he had made”, which he said hampered his ability to perform the role.
He claims losses and damages totalling at least $409,000 for past losses and reduced income from being unable to work.
