Decision looms on an interim injunction to save trees from being felled at Osgoode Hall

A judge heard arguments Saturday from Metrolinx, calling for the trees’ removal, and from Ontario’s Law Society that says the trees lend heritage value

Work to cut down centuries-old trees at Osgoode Hall began and was then halted Saturday as an interim injunction to stop the removal was argued in a Toronto courtroom.

“Despite an injunction being filed, Metrolinx quickly ramped up its plan to remove the trees,” BOLD said in a statement on Saturday. If a temporary halt to the tree removal is granted, Fenrick said the Law Society intends to present the courts with an architect’s report detailing the potential damage posed to the heritage value of the site at Queen Street West and University Avenue.

But lawyers for Metrolinx argued that further reviews will have no legal bearing on provincial clearances already granted. “It is a collateral attack on the decision of a minister made under the Ontario Heritage Act,” said Metrolinx lawyer Sam Rogers. Fenrick said there needs to be further due diligence done on potential alternative sites, such as the nearby Campbell House museum lands.
