But defence counsel Paul Moreau, who represents accused gunman Samuel Lugela, said allowing such a procedure would compromise his client’s ability to answer the prosecution case.Article content “I have great concern about this witness’s motivation,” Moreau said, noting Tsege initially sought a $10,000 payment to return to give evidence.The lawyer said allowing Tsege to testify from halfway around the world would create multiple problems with his credibility and hamstring he and lawyer Derek Jugnauth, who represents co-accused Feysal Osman Adbul-Aziz, in their cross-examination.
Because of logistic issues, the witness would only be available until 8 p.m. Addis Ababa time each day, or 10 a.m. Calgary time. Even starting court at 8 a.m. would limit cross-examination to two hours, likely leading to multiple days of testimony, Moreau said.Article content“Giving a witness a 22-hour break over and over again . . . who knows what they’re going to do.”
Moreau said unlike with witnesses testifying here in Canada, Jeffrey would have no control over Tsege discussing his evidence with others or seeking out information that might change his evidence.“It’s a highly unsatisfactory way to receive important evidence.”
