The Commission on Elections (Comelec) en banc has denied the motion for reconsideration filed by dismissed Mandaue City mayor Jonas Cortes . The Comelec upheld its earlier resolution to cancel Cortes' certificate of candidacy (COC). This decision comes after the Comelec released updates on special proceedings actions petitions related to the May 12, 2025, national and local elections and the Bangsamoro Autonomous Region in Muslim Mindanao’s parliamentary elections on Friday, December 27, 2024.
Cortes was included in the list of candidates whose COCs were denied due course or canceled, disqualifying him from running for various elective positions in the upcoming elections. Cortes filed his motion for reconsideration on December 23, seeking to overturn the Second Division's earlier decision. Allies of Cortes said they are ready to face the outcome of the Comelec en banc decision. City Administrator Jamaal James Calipayan told reporters that the appeal asks the Comelec en banc to set aside the earlier decision and grant due course to Cortes' COC. Calipayan said they are prepared for either a positive or negative outcome. If the Comelec en banc rules against Cortes, his legal team plans to escalate the matter to the Supreme Court. Calipayan emphasized the urgency of resolving the issue as ballot printing is scheduled to begin in the first week of January 2025. He expressed hope that the Comelec's decision will be expedited and that if adverse to Cortes' candidacy, they will seek a remedy from the Supreme Court. Cortes' legal team has outlined potential legal remedies, including seeking a temporary restraining order (TRO) or a status quo ante order
