The Commission on Elections ( Comelec ) has denied a motion for reconsideration that challenged the cancellation of Noel Rosal 's certificate of candidacy for Albay governor in the May 2025 polls. The Comelec en banc found no merit in Rosal's motion, stating that it was a 'mere rehash' of previous arguments.

The Comelec emphasized that the petition to disqualify Rosal was granted based on grounds of denial of due course to or cancellation of his certificate of candidacy and disqualification, as outlined in the allegations of the petition. The Comelec agreed with its Second Division's assessment that there were factual grounds to disqualify Rosal under Section 40 (b) of the Local Government Code, which prohibits individuals found guilty of grave misconduct from holding public office. This decision stems from the Office of the Ombudsman's finding of Rosal guilty of grave misconduct and oppression for his unjustified reassignment of three department heads to lower-ranked positions. As a result, Rosal was dismissed from service, disqualified from running for local elective positions, and barred from holding any public office
