Burke said the city’s decision to fire the officer in November 2020 was based on the findings of a neutral investigator who determined he discriminated against the women, and violated the city’s anti-discrimination policy and the Human Rights Code. Local 79 president Casey Barnett said the union is “frustrated that the city still will not accept the arbitrator’s award,” but it won’t comment further while the case is before the courts.
The pair alleged that in addition to making the “trespass and shoot” comment, the officer asked for their ID but didn’t make the same request of other people at the stadium. He also attempted to record their licence plate number as they left the park.
