While the Supreme Court has judicial oversight, Bernstein’s office has a statutory oversight role. That means he can compel documents and testimony, along with releasing reports with recommendations and criticism of systemic issues, he said. There would be no guarantee of transparency if the department was left to handle things on its own, Bernstein said.

“The Department of Social Development and Seniors is working with the Child and Youth Advocate’s Office on the independent investigation and looks forward to receiving the findings of the review,” a spokesperson for the department said in an emailed statement on April 20. The decision suggests the appeal court gave undue weight to the arguments of the father and Child Protective Services’ expert witness, a psychologist who had previously worked for the father.
