Calgary private school loses latest appeal of Muslim prayer order yyc
The dispute was triggered in February 2012 when the parents of two students denied a space to pray at the school filed complaints with the Alberta Human Rights Commission. The students’ Sunni religious beliefs required them to pray five times a day, including once or twice a day during school hours.
The case was heard in June 2014 before a commission tribunal ruled the following year that the school hadWebber Academy appealed that decision to the then-Court of Queen’s Bench, which rejected the appeal. The school opposed that decision to the Alberta Court of Appeal, which ordered a new Alberta Human Rights tribunal hearing.This advertisement has not loaded yet, but your article continues below.When the second tribunal upheld the original discrimination finding, Webber appealed that outcome to the Court of Queen’s Bench, which in 2021 again dismissed the school’s challenge.The Supreme Court has previously declined to hear the case.
“The Tribunal did not err when it found that providing the students with access to a quiet, private space to pray did not interfere with Webber Academy’s right to freedom of religion in a manner that was more than trivial or insubstantial,” the justices wrote. “In our view, it cannot reasonably be suggested that Webber Academy is endorsing any religion or religious practice, and should not be seen to be doing so, simply by providing such accommodation.”Article content
