“This application … is not about guilt, or innocence,” said Sullivan, who found McKinnon and her then-lover, Joseph Bruso guilty of first-degree murder in the June 14, 2003, fatal shooting of Nicholas Maradyn.Article contentThe judge told the jury array that McKinnon was sentenced to an automatic life sentence with no parole eligibility for a minimum 25 years.
“However, there is an exception,” Sullivan said, of the so-called faint hope application which was abolished by Parliament in 2011. Because McKinnon was convicted before the legislation was changed, she remains eligible for the application. “This review process gives the jury the power to reduce the parole ineligibility from 25 years, once the applicant has reached at least 15 years of the sentence, and that’s why we’re here today.”
He listed the witnesses who will be testifying, including McKinnon and Vicky Maradyn, the sister of the deceased.Article content
