Province working with feds to make changes to legality of possession
Premier David Eby says his government is working with the federal government to make illicit drug use illegal in all public spaces, including inside hospitals, on transit and in parks.
These changes require federal approval. Reporters were told B.C. has already had discussions with the federal government and B.C. expects the changes to happen quickly. The next provincial election is less than six months away. The changes will provide police with the power to enforce drug use restrictions in all public spaces, the province says. However, “guidance” will be given to police to only arrest for simple possession of illicit drugs in “exceptional circumstances.”
A new policy prohibiting street-drug possession or use is also aimed at improving safety and security for patients, visitors and health-care workers in hospitals. The requested changes run counter to last December’s ruling by B.C. Supreme Court Chief Justice Christopher Hinkson against B.C.’s Restricting Public Consumption of Illegal Substances Act.
