Apex court grants Orang Asli tribe leave to appeal over building of dam FMTNews
The Orang Asli settlers of Ulu Geruntum in Gopeng are appealing to the Federal Court to restore an interim injunction to prevent the construction of a dam.
The question approved by the apex court involves whether in an interpretation of Section 18 of the Specific Relief Act 1950, an action for recovery of land can seek both specific relief and an alternative claim for damages. The plaintiffs want work on the dam to be stopped as it infringes their community’s rights to their ancestral land which they claim was cleared without their consent.
