Police will be able to freely access an accused bikie’s phone, seized after an alleged assault outside a Gold Coast gym, after he failed in a court bid to limit what investigators could access.
He was arrested four days later, along with three other men. They were all charged with assault occasioning bodily harm whilst in company, as a participant in a criminal organisation. When a search warrant was executed on March 4, 2022, Barbaro refused to give police access to the phone, pending a resolution of his claims of legal professional privilege.
In a judgment published on Friday, Supreme Court Justice Melanie Hindman said the law allowed for such a search.
