In a 90-page ruling released late Monday, Calgary Court of King’s Bench Justice Barbara Romaine also found that the restrictions including masking, distancing and capacity limits did not violateThe court action, referred to as the Ingram case, began in late 2020 and involved claims from three individuals and two churches who together challenged the constitutional validity of public health measures imposed during the early months of the pandemic.
Romaine ruled that the Public Health Act requires such health orders to be implemented by public health officials, not politicians, with her ruling stating that “although Hinshaw was maligned during the pandemic and afterwards as the symbol of the restrictions, she was not in fact the final decision-maker.”
